Refund Policy for Consultancy Services

1. General Refund Policy

  • No Refunds for Completed Services: Once a consultancy service has been fully completed and delivered in accordance with the agreed-upon terms, no refunds will be provided.
  • Refunds for Uncompleted Services: If a consultancy service is not completed due to the Consultant’s fault or breach of contract, a refund may be considered. The amount of the refund will be determined on a case-by-case basis, taking into account the value of the services already provided and the reason for the non-completion.
  • Client Cancellation: If a Client cancels a consultancy service before it has begun, a refund may be considered. However, the Consultant may retain a portion of the agreed-upon fee to cover administrative costs or lost opportunities.

2. Refund Procedure

  • Refund Request: Any refund request must be submitted in writing to the Consultant within 10 days of the event that triggered the refund.
  • Documentation: The Client may be required to provide documentation to support their refund request, such as proof of unsatisfactory service or evidence of the Consultant’s breach of contract.
  • Review and Decision: The Consultant will review the refund request and supporting documentation. The Consultant will notify the Client of their decision regarding the refund within 30 days of receiving the request.

3. Exceptions

  • Intellectual Property: Refunds will not be provided for intellectual property rights that have been transferred to the Client.
  • Force Majeure: The Consultant will not be liable for refunds if the non-completion of the consultancy service is due to a force majeure event, such as a natural disaster, war, or government action.

4. Dispute Resolution

  • Negotiation: In the event of a dispute regarding a refund, the parties will attempt to resolve the dispute through negotiation.
  • Mediation: If negotiation fails to resolve the dispute, the parties may agree to submit the dispute to mediation.
  • Arbitration: If mediation fails to resolve the dispute, the parties may agree to submit the dispute to binding arbitration.

5. Governing Law

This Refund Policy shall be governed by and construed in accordance with the laws of Kenya. Any dispute arising under or in connection with this Refund Policy shall be submitted to the exclusive jurisdiction of the courts of Kenya.
